Question Should "following orders" be an excuse?

Here's a subject that different people always have a slightly different answer. Here's the situation: Let's say a Nazi who worked at a concentration camp is going to trial. If he did not work for them, they would of killed him. Now, he is sentenced to life for working at a concentration camp.

Crude example, but do you get the point. Should "following orders" be an excuse?

All right......

Your question is far too broad.....

"Following Orders" can be either good or bad, sometimes neither.....
But one thing is for certain......you limit your sense of responsibility for the action/crime/procedure that takes place upon your hands.....

Thus forgoing any sense of "guilt" being felt by your soul......
and making you feel like "It's not my fault, I was ORDERED to do it."
Hence accessory to committing a crime, and not a long term sentence in court.......yadda yadda yadda.....

Marvman has been in the military for a couple years......
still working closely with them now.....
and there is a clause in your contract before you sign on.....
it's called the "Conciencious Objectionary" clause.....
for those who deem to have a "concience".......
we all know that soldiers a trained to follow orders......
thats JUST HOW IT GOES.......a hieracrchy.....you follow your superior officer......and upper chain of command.......people all know that wars are not started by regular soldiers.....rather by those who have power........

So.....
following orders.....could be deemed as an excuse......
but it would be better stated, that it doing such is just "doing your job".
As what you are trained to do.

If it's contractually obligated, maybe. It depends on the act. This is very much a grey area on liabilities. Taking life to preserve your own may seem selfish from an outside look, but it's a very natural human instinct to do drastic things under life threatening conditions. Definitely not something we could sentence the Nazi used in your example to death or a life sentence for considering the circumstances.

Exactly.

The laws of the time in Germany would be considered evil now, but they were law back then. Who decides what laws should be broken?
For example, should the people who protested Vietnam by dodging the draft be held accountable for their opposition to what they thought was an unjust war?
Their crime is treason, but what if the war went against their conscience?

The Nazi dilemma is not so far removed from this.


BTW, was this question inspired by a recent watching of the movie The Reader? Just wondering...
